By accessing or using Track Racer IO ("the Game"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Game.
You must be at least 13 years of age to use the Game. If you are under 18, you must have parental or guardian consent. By using the Game, you represent that you meet these requirements.
You may create an account using email/password, Google Sign-In, or Discord Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree not to share your account or allow others to access it. We reserve the right to suspend or terminate accounts that violate these terms.
You agree not to: (a) use cheats, exploits, automation tools, or unauthorized third-party software; (b) harass, abuse, threaten, or harm other players; (c) impersonate any person or entity; (d) attempt to gain unauthorized access to our systems or other players' accounts; (e) manipulate leaderboards, race times, or game statistics; (f) use the Game for any illegal purpose; (g) reverse-engineer, decompile, or disassemble any part of the Game.
By creating and publishing tracks, levels, or other content in the Game, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, modify, and distribute that content within the Game and for promotional purposes. You retain ownership of your original content. You represent that your content does not infringe any third-party rights. We may remove user content at our discretion without notice.
The Game offers optional in-app purchases and subscriptions processed through RevenueCat and the applicable platform store. All purchases are final and non-refundable except as required by applicable law or platform policy. Virtual items, currencies, and cosmetics have no real-world monetary value and cannot be exchanged, traded, or refunded for real money. Subscription terms, pricing, and renewal policies are displayed at the time of purchase. You may manage or cancel subscriptions through your platform account settings.
Track Racer IO does not display third-party advertisements. The Game is ad-free.
The Game uses GameAnalytics to collect anonymized gameplay and usage data, including session information, progression events, and performance metrics. This data is used solely to improve the Game experience. GameAnalytics processes data in accordance with its own privacy policy (https://gameanalytics.com/privacy). By using the Game, you consent to this data collection.
The Game, including its code, graphics, audio, 3D models, UI design, and all related assets, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Game without our prior written permission.
The Game is provided on an "as available" basis. We do not guarantee uninterrupted, error-free, or secure service. We may modify, suspend, or discontinue the Game (or any part of it) at any time without prior notice, including during alpha, beta, or early access periods. We are not liable for any loss of progress, data, or virtual items resulting from service interruptions.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE GAME, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, VIRTUAL ITEMS, OR GAME PROGRESS.
We may suspend or terminate your access to the Game at any time, with or without cause, and with or without notice. Upon termination, your license to use the Game ceases immediately. Sections regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved in the appropriate courts of the jurisdiction in which we operate.
We may update these ToS at any time. Significant changes will be communicated via in-game notifications or email. Continued use after updates constitutes acceptance.
